Karnataka High Court Sets Aside Maintenance Order for Wife Earning Independently

BENGALURU: The Karnataka High Court has set aside a Family Court order directing a husband to pay monthly maintenance of ₹20,000 to his wife, observing that an economically independent woman who earns sufficient income to support herself cannot automatically claim maintenance from her husband.

The High Court passed the order on October 30 while allowing a petition filed by the husband challenging the Family Court’s July 4, 2025, order granting maintenance to his wife.

During the proceedings, the husband contended that his wife holds a degree in Computer Science Engineering and works for a private company, earning approximately ₹10 lakh annually. He further pointed out that, according to her own submission before the court, she earns ₹54,700 per month, which he argued was sufficient to meet her living expenses.

The husband also submitted that he is diabetic and requires insulin injections four times a day. Although he earns approximately ₹2 lakh per month, he claimed to spend around ₹70,000 on medical expenses for himself and his parents. He also highlighted the substantial legal expenses arising from multiple cases filed by his wife.

Opposing the petition, the wife alleged that her husband had concealed his medical condition before their marriage and subjected her to harassment, dowry demands and ill-treatment after marriage.

Justice Dr. Chillakur Sumalatha, while examining the matter, observed that gainful employment, financial independence and the ability to maintain oneself are relevant considerations when deciding a wife’s claim for maintenance.

“The law does not say that a married woman must be financially supported by her husband in every case. If a wife is well-educated, suitably employed and earns sufficient income to maintain herself, she cannot automatically be treated as financially dependent on her husband,” the High Court observed.

The Family Court had earlier directed the husband to pay ₹20,000 per month, reasoning that despite the wife’s monthly income of ₹54,700, the husband’s comparatively higher earnings entitled her to financial support.

However, the High Court took a different view, noting that the wife had admitted during the proceedings that she was earning independently and supporting her parents.

The court observed that her financial circumstances did not establish the kind of dependency on her husband required to justify the maintenance order in the circumstances of the case.

Accordingly, the High Court set aside the Family Court’s order directing the husband to pay ₹20,000 per month as maintenance.

The ruling highlights the importance of considering a wife’s independent income, financial capacity and actual dependency while deciding maintenance claims. It does not, however, establish that every employed or earning wife is automatically disqualified from receiving maintenance.
